Hey Wizard NFC Tap Card Terms and Conditions

Welcome to Hey Wizard! These Terms and Conditions (“Terms”) govern your use of the Hey Wizard NFC Tap Card (“Card”) and related services. By purchasing, activating, or using the Hey Wizard NFC Tap Card, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Card.

The Hey Wizard NFC Tap Card allows you to share your Hey Wizard expert profile with potential clients by tapping the card on any NFC-enabled device. The card provides easy access to your contact details, services, and booking options, both locally and virtually.

To activate your NFC Tap Card, you must:

1. Download the Hey Wizard Expert App from the App Store or Google Play Store.
2. Complete your profile within the app.
3. Navigate to the “Add NFC Card” option within the app and follow the on-screen instructions to activate the card.

Once activated, the card can be tapped on any NFC-enabled device to share your Hey Wizard profile, including your contact details, services, video introduction, and more.

You are responsible for the use and care of your Hey Wizard NFC Tap Card. Hey Wizard is not liable for any loss or damage to your card. If your card is lost or damaged, you may order a replacement through the Hey Wizard Expert App or website.
You are responsible for keeping your Hey Wizard profile information up-to-date. Changes to your profile will automatically be reflected when your NFC Tap Card is tapped by clients.

At the time of purchase, the Hey Wizard NFC Tap Card is a one-time purchase. However, Hey Wizard reserves the right to introduce subscription plans for continued use of certain advanced features or functionalities in the future.

• Notification of Subscription: If a subscription becomes required, you will be notified in advance, and you will have the option to subscribe or discontinue use of the advanced features tied to the NFC Tap Card.
• Subscription Options: If introduced, subscription pricing and tiers will be clearly communicated to you via the Hey Wizard Expert App or website.

Failure to Subscribe: If a subscription is required in the future and you choose not to subscribe, you may still retain basic functionality of the card, but certain advanced featu

All purchases of the Hey Wizard NFC Tap Card are final and non-refundable unless the card is defective or damaged upon receipt. In the case of a defective card, please contact Hey Wizard Support within 30 days of receiving your card for a replacement.

The Hey Wizard NFC Tap Card is designed to integrate seamlessly with the Hey Wizard Expert App. It may also support third-party integrations, such as payment processors (e.g., PayPal, Stripe), booking platforms (e.g., Calendly), and social media platforms.

Hey Wizard is not responsible for any issues arising from third-party integrations or external services. You are responsible for complying with the terms and conditions of any third-party services you choose to integrate with your Hey Wizard profile.

Hey Wizard is not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the NFC Tap Card, the Hey Wizard Expert App, or any related services. This includes, but is not limited to, loss of business, loss of income, or damage to your reputation as a result of using the Hey Wizard NFC Tap Card.

Hey Wizard reserves the right to update or modify these Terms at any time. If changes are made, you will be notified via email or through the Hey Wizard Expert App. Continued use of the NFC Tap Card after modifications to the Terms indicates your acceptance of the new Terms.

Hey Wizard respects your privacy and will only collect, use, and share your personal data in accordance with our Privacy Policy. By using the Hey Wizard NFC Tap Card and the Expert App, you consent to the collection and use of data as described in our Privacy Policy.

Hey Wizard reserves the right to terminate or suspend access to your Hey Wizard NFC Tap Card at any time for violations of these Terms or for any other reason. Upon termination, you must cease using the card, and your access to Hey Wizard services may be limited.

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of [Your Jurisdiction].

Use of Information Provided by Experts:
Hey Wizard facilitates the sharing of information between experts and clients. Hey Wizard is not responsible for the accuracy, reliability, or legality of any information or advice provided by the expert via the Hey Wizard NFC Tap Card or the Hey Wizard Expert App. Clients are advised to verify the credentials of experts independently.

No Warranty on Continuous Availability:
Hey Wizard does not guarantee that the NFC Tap Card, Hey Wizard Expert App, or any related services will be available at all times. Temporary interruptions or delays may occur due to technical issues, maintenance, or other unforeseen circumstances. Hey Wizard disclaims all liability for any loss, inconvenience, or damages arising from such interruptions.

Misuse of the NFC Tap Card:
Hey Wizard is not responsible for any unauthorized or improper use of the NFC Tap Card by third parties, including but not limited to, instances of fraud, misrepresentation, or misuse of the card. The expert is responsible for safeguarding their card and ensuring its proper use.

Hey Wizard provides a platform for experts to promote their services and connect with clients. Hey Wizard makes no guarantees about the amount of business or income an expert may generate from using the NFC Tap Card or the Hey Wizard Expert App. Any claims regarding potential earnings or business results are purely illustrative and based on individual experiences.

By using the Hey Wizard NFC Tap Card, you agree to indemnify, defend, and hold harmless Hey Wizard, its affiliates, officers, directors, employees, agents, and contractors from and against any and all claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney fees) arising out of or related to your use or misuse of the card, the Hey Wizard Expert App, or any services provided through Hey Wizard. This includes, but is not limited to, claims related to:

• Misrepresentation of your services.
• Inaccurate or false information provided in your profile.
• Failure to fulfill obligations to clients.

Hey Wizard allows experts to share profiles, video introductions, and other content via the NFC Tap Card and Expert App. Experts are solely responsible for the content they create and share. Hey Wizard reserves the right to remove any content deemed inappropriate, misleading, or in violation of these Terms. Hey Wizard disclaims any liability for user-generated content, including but not limited to errors, omissions, or illegal content.

If your Hey Wizard NFC Tap Card or Expert profile integrates with third-party services (e.g., payment processors, video conferencing, or scheduling tools), Hey Wizard is not responsible for the availability, reliability, or functionality of those third-party services. Any interactions or transactions that occur using third-party services are solely between you and the third-party provider.

Any disputes arising from the use of the Hey Wizard NFC Tap Card or related services must be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (or your local jurisdiction’s equivalent). By agreeing to these Terms, you waive your right to participate in a class-action lawsuit or other group litigation.
